What’s Form is Used for Adjustment of Status?

Adjustment of status is the process used to get your green card while living in the country. Your application must go directly through the U.S. Citizenship and Immigration Services (USCIS) instead of a consulate abroad.

yTo apply for a green card, you must fill out and submit Form I-485, Application to Register Permanent Residence or Adjust Status. This form is used to change your nonimmigrant status to a lawful permanent resident (LPR).

We suggest going through this process with an adjustment of status lawyer. There are many forms and processes that require a thorough understanding of immigration law.

Contact an Adjustment of Status Lawyer if Your Plans Have Changed as a Temporary Visa Holder

Nonimmigrant visas are issued to people who plan to return to their home country. If you came to the U.S. on a temporary visa and decide to live here instead, it’d be wise to speak with an adjustment of status lawyer experienced in both immigrant visas and the adjustment of status process.

Your adjustment of status lawyer can help you get a green card while in the U.S. on a temporary visa, though you must be the beneficiary of an immigrant visa petition. Typically, a sponsor must petition USCIS for your immigrant visa before you can apply for an adjustment of status.

U.S. immigration law is very specific about who can sponsor an immigrant’s visa. It is limited to U.S. citizens and LPRs who have a relation to you and U.S. employers who meet specific requirements.

You could be eligible to petition for a visa without a sponsor if you have:

  • An employment-based petition with a National Interest Waiver
  • An employment-based petition based on some extraordinary ability
  • The ability to invest a substantial amount of money into a U.S. business
  • Experienced abuse by anyone who would have otherwise been eligible to sponsor you.

If you have an immigrant visa, it’ll take several months to process your adjustment of status application and get you your green card.

Once you’ve waited one year as an asylee, your adjustment of status should take less than 18 months.

After waiting three years to be eligible to apply for adjustment of status, you may still need to wait approximately two years for your green card.
